Is overtaking from the right legal? I have seen so many times that motorcycles and even cars overtake from the right. In a long ride this weekend, I called out several mtb riders who overtook from the right, one cut me as soon as he overtook me, and saw at least two dozen MC who overtook from the right, two vans and one car overtook from the right.
To settle once and for all the issue, the post referred to the net.
Here is what Section 39 of the LTO law RA 4136 says
Section 39. Overtaking a vehicle. - The driver of any motor vehicle overtaking another vehicle proceeding in the same direction shall pass at a safe distance to the left thereof, and shall not again drive to the right side of the highway until safety clear of such overtaken vehicle except that on a highway, within a business or residential district, having two or more lanes for the movement of traffic in one direction, the driver of a vehicle may overtake and pass another vehicle on the right. Nothing in this section shall be construed to prohibit a driver overtaking and passing, upon the right, another vehicle which is making or about to make a left turn.
The post says it is not illegal if there are two or more lanes However it is a dangerous.
The post mentions of a bus running over an mc that overtook from the right. It is the blind spot of the bus.
Shall we be legal or shall we be safe?
